Privacy Notice – Instagram Giveaway

This notice applies to the Instagram giveaway run by @seasidecapecoral from September 28 to October 4, 2026. It supplements Section 10 of the Official Rules.
1. Controller and Contact

Privacy questions can be sent to this email address or asked by phone in English or German.
2. Data We Process
From all entrants: Instagram username, content and time of the entry comment (including the travel month named).
Additionally from the winner:
- name, date of birth and country of residence to verify eligibility
- the content of communication via Instagram direct message and email
- when the discount is redeemed, the information required for the booking
An ID document is only requested if there are reasonable doubts, and it is then only viewed, for example during a video call. No copy is stored.
From a companion: If the winner is under 25, we process the name, contact details and booking information of the companion who makes the booking.
3. Purposes and Legal Bases
- Running the giveaway: drawing, notification, verification of eligibility and granting the discount, including a booking made by a companion. Legal basis: Article 6(1)(b) GDPR.
- Preventing misuse and keeping records: excluding manipulated entries, documenting that the drawing was conducted properly and defending against claims. Legal basis: our legitimate interests under Article 6(1)(f) GDPR.
- Legal obligations: record-keeping and tax obligations in connection with a booking. Legal basis: Article 6(1)(c) GDPR.
- Public announcement of the winner: only with separate consent under Article 6(1)(a) GDPR.
Entering does not subscribe you to a newsletter. We do not use entries to target entrants with advertising afterwards.

The owners of the vacation homes do not receive any data from the giveaway. We only disclose data to authorities or tax advisors where required by law.
5. Processing in the United States
We are based in the United States. Entrants' data are therefore processed in the US, by us and by the US service providers listed in Section 4.
The level of data protection in the US does not correspond in every respect to that of the European Union. In particular, US authorities may access data under certain conditions. Where the GDPR applies, entrants nevertheless have all GDPR rights against us.
6. Retention

The comments themselves remain visible under the Instagram post for as long as the post is online. Entrants can delete their comment at any time. Anyone who deletes their comment before the entry deadline is no longer included in the drawing.
7. Required Data; No Profiling
It is not possible to enter without an Instagram username and a comment. The prize cannot be granted without the information needed to verify eligibility. There is no statutory obligation to provide these data.
The winner is selected purely at random using a tool. No evaluation of personal characteristics (profiling) takes place.
8. Your Rights
Where the GDPR applies, entrants have the right to:
- access the data stored about them (Article 15 GDPR)
- rectification of inaccurate data (Article 16 GDPR)
- erasure (Article 17 GDPR)
- restriction of processing (Article 18 GDPR)
- data portability (Article 20 GDPR)
- object to processing based on legitimate interests (Article 21 GDPR)
- withdraw consent with effect for the future (Article 7(3) GDPR)
An informal email to info@seasidecapecoral.com is sufficient.
Entrants also have the right to lodge a complaint with a data protection supervisory authority, in particular in the EU member state of their habitual residence or place of work (Article 77 GDPR).
